These Terms and Conditions ("Agreement") outline the rules and regulations for the use of True Glassy App ("Application"). By using this Application, we assume you accept these terms and conditions in full. Do not continue to use True Glassy if you do not accept all of the terms and conditions stated on this page.

True Glassy is licensed to You (end users) by TRUE GLASSY LTD, located and registered at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ, for use only under the terms of this License Agreement. By downloading the Application from the Apple App Store, Google Play Store, or any other platform that may be available, and any updates thereto (as permitted by this License Agreement), You indicate that You agree to be bound by all of the terms and conditions of this License Agreement and that You accept this License Agreement.

The Application is provided to You "AS IS" and "AS AVAILABLE," with all faults and defects, and without warranty of any kind. To the fullest extent permissible under applicable law, the Licensor disclaims all warranties, express or implied.

All rights not expressly granted to You in this License Agreement are reserved by the Licensor.

By accepting these terms and conditions, you acknowledge that you have read, understood, and agreed to be bound by this Agreement, and that this Agreement has the same force and effect as a signed agreement.

 

THE APPLICATION

 

True Glassy is a software for personalized skincare guides, offering detailed information on various cosmetic products with a unique way of reviews. It functions as a tool to assess the compatibility of skincare products with different skin matrices, like skin type, skin conditions, and skin concerns. With the ability to find products with various filter options, and log skincare routine info to the diary. With many features to come along in the near future.

It is important to note that the Application is not designed to comply with industry-specific regulations such as the Health Insurance Portability and Accountability Act (HIPAA), Federal Information Security Management Act (FISMA), and others. Therefore, if your interactions require adherence to such laws, you should refrain from using this Application. Additionally, the Application should not be used in ways that violate the Gramm-Leach-Bliley Act (GLBA).

 

SCOPE OF LICENSE

 

True Glassy, including its content, features, and services, is owned and operated by TRUE GLASSY LTD. Unless otherwise stated, TRUE GLASSY LTD and/or its licensors hold the intellectual property rights for all material on True Glassy, and all these intellectual property rights are reserved. You are granted a limited license only, subject to the restrictions provided in these terms and conditions, for purposes of viewing the material contained on True Glassy for your personal, non-commercial use. Any other use of content from the Application, including but not limited to modification, reproduction, or distribution, without the prior written permission of TRUE GLASSY LTD, is strictly prohibited.

By using the Application, you agree to adhere to all restrictions set forth in these terms and conditions, respecting the intellectual property rights of TRUE GLASSY LTD and its licensors. Unauthorized use of the Application or its content may give rise to a claim for damages and/or be a criminal offence.

 

You are granted a limited, non-transferable, non-exclusive, and non-sublicensable license to install and use the Licensed Application solely on Apple or Android products that you own or control, strictly in accordance with these terms.

You are prohibited from making the Application available to third parties. This includes, but is not limited to, selling, renting, leasing, or redistributing the Application in any unauthorized manner. Any sharing of the Application must comply with the terms set by Apple or Google and requires the prior written consent of True Glassy.

Any form of reverse engineering, translation, disassembly, decompilation, modification, or creation of derivative works from the Application is strictly forbidden unless you have obtained prior written consent from True Glassy. You are not allowed to attempt to derive the source code of the Application, or any part thereof, nor integrate it with other software, or adapt it in any way that violates these terms.

By adhering to these terms, you help ensure the continued integrity, security, and functionality of the Application, and help protect the intellectual property rights of True Glassy. Any violation of these terms may result in the termination of your license and access to the Application.

 

You are not allowed to copy, modify, or alter the Application in any way, except as expressly authorized by this license and the Usage Rules. You are permitted to create and store backup copies of the Application on devices that you own or control, as long as this is done in accordance with this license, the App Store Terms of Service, and any other applicable terms and conditions. Intellectual property notices must remain intact and unauthorized third parties should not have access to these copies.

Republishing material from True Glassy
Selling, renting, or sub-licensing material from True Glassy
Reproducing, duplicating, or copying material from True Glassy
Redistributing content from True Glassy

 

Violating or attempting to violate these obligations may result in legal action and the imposition of damages.

TRUE GLASSY LTD reserves the right to change these licensing terms and conditions as necessary.

You are also required to comply with any applicable third-party terms when using the Application. This license does not excuse you from such responsibilities.

TECHNICAL REQUIREMENTS

It is your responsibility to ensure that your device meets the required technical specifications to use the Application.

The Application requires an active internet connection to function properly. This connection can be Wi-Fi, or provided by your mobile network provider, but TRUE GLASSY LTD cannot be held responsible if the Application does not work at full functionality due to a lack of internet access or if you have run out of data allowance. If you are using the Application outside of a Wi-Fi area, you should be aware that your mobile network provider's terms and conditions will still apply, and you may incur charges from your mobile provider for the duration of the connection while accessing the Application. Any such charges, including roaming data charges if you use the Application outside of your home territory without turning off data roaming, are your responsibility. If you are not the bill payer for the device being used to access the Application, it is assumed that you have obtained permission from the bill payer.

TRUE GLASSY LTD reserves the right to modify the technical specifications as deemed necessary.

NO MAINTENANCE OR SUPPORT

TRUE GLASSY LTD is under no obligation, expressed or implied, to provide any form of maintenance, technical support, or updates for the Application.

 

USE OF DATA

By using True Glassy, you acknowledge and consent to True Glassy LTD’s access to, adjustment of, and use of your downloaded licensed Application content and personal information. The utilization of such data by True Glassy LTD is governed by your legal agreements with us and is subject to our privacy policy, available at True Glassy Privacy Policy.

USER GENERATED CONTRIBUTIONS

True Glassy offers features that allow you to engage with the Application and other users, including but not limited to comments, chats, blogs, message boards, and forums. You may also have the opportunity to create, submit, post, display, transmit, or distribute content and materials, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information (collectively, "Contributions"). Please note that these Contributions may be visible to other users and on third-party platforms.

It is important to clarify that Contributions represent the personal views and opinions of the individual users and not those of True Glassy LTD, its agents, or affiliates. To the fullest extent permitted by law, True Glassy LTD shall not bear responsibility or liability for any Contributions, nor for any costs, damages, or liabilities arising from the use, posting, or appearance of Contributions within the Application.

When contributing to True Glassy, you agree and confirm that:

Your Contributions do not infringe upon the intellectual property rights, including copyrights, patents, trademarks, trade secrets, or moral rights, of any third party.
You hold ownership or possess the necessary licenses, rights, consents, and permissions to use, and authorize True Glassy LTD, the Application, and other users to use your Contributions in the ways anticipated by the Application and these Terms of Use.
You have obtained the required consents and permissions from any identifiable individuals featured in your Contributions for their name, likeness, or other related information to be used in accordance with the Application and these Terms of Use.
Your Contributions are truthful, accurate, and not misleading.
Your Contributions are not forms of unsolicited or unauthorized promotions, advertisements, or spam.
Your Contributions do not contain content that is obscene, violent, harassing, libelous, slanderous, or otherwise objectionable as determined by True Glassy LTD.
Your Contributions do not insult, ridicule, mock, intimidate, or abuse any individual or group.

 

to True Glassy LTD an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such Contributions (including, without limitation, your image and voice) for any purpose, commercial, advertising, or otherwise, and to prepare derivative works of, or incorporate into other works, such Contributions, and grant and authorize sublicenses of the foregoing. The use and distribution may occur in any media formats and through any media channels.

This license will apply to any form, media, or technology now known or hereafter developed, and includes our use of your name, company name, and franchise name, as applicable, and any of the trademarks, service marks, trade names, logos, and personal and commercial images you provide. You waive all moral rights in your Contributions, and you warrant that moral rights have not otherwise been asserted in your Contributions.

We do not assert any ownership over your Contributions. You retain full ownership of all of your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions. We are not liable for any statements or representations in your Contributions provided by you in any area on the Application. You are solely responsible for your Contributions to the Application and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Contributions.

We have the right, in our sole and absolute discretion, (1) to edit, redact, or otherwise change any Contributions; (2) to re-categorize any Contributions to place them in more appropriate locations on the Application; and (3) to pre-screen or delete any Contributions at any time and for any reason, without notice. We have no obligation to monitor your Contributions.

 

TRUE GLASSY LTD takes no accountability or responsibility for any damages caused due to a breach of duties according to Section 2 of this Agreement. To avoid data loss, you are required to make use of backup functions of the Application to the extent allowed by applicable third-party terms and conditions of use. You are aware that in case of alterations or manipulations of the Application, you will not have access to licensed Application.

TRUE GLASSY LTD takes no accountability and responsibility in case of skin problems (irritation, rashes, redness) that might appear after using products from the app.

TRUE GLASSY LTD takes no accountability and responsibility in case of misdiagnosed diseases. TRUE GLASSY is not a medical advisor and should not be used to self-diagnose. If you suspect you have a medical condition or a disease, please contact your doctor.

TRUE GLASSY LTD takes no accountability and responsibility in case of displaying wrong or otherwise not up-to-date information regarding products, brands, and countries.

TRUE GLASSY LTD takes no accountability and responsibility in case of incorrect information that might appear in the skincare wiki.

TRUE GLASSY LTD takes no accountability and responsibility in case of any problems that might arise after purchasing a product from third-party marketplaces, including but not limited to: orders, package delivery issues, damaged packages, and payment issues.

By agreeing to these terms, you are acknowledging the limitations of liability set forth by TRUE GLASSY LTD and agree to indemnify and hold harmless TRUE GLASSY LTD from any claims or liabilities arising out of your use of the Application. You also understand and accept that the Application is not intended to provide medical advice, and any skin problems or diseases should be reviewed with a medical professional. TRUE GLASSY LTD strives to provide accurate and up-to-date information but does not guarantee the reliability, accuracy, or completeness of any information in the Application.

 

 

 

WARRANTY

TRUE GLASSY LTD warrants that the Application is free of spyware, Trojan horses, viruses, or any other malware at the time of your download. TRUE GLASSY LTD warrants that the Application works as described in the user documentation.

No warranty is provided for the Application that is not executable on the device, that has been unauthorizedly modified, handled inappropriately or culpably, combined or installed with inappropriate hardware or software, used with inappropriate accessories, regardless if by yourself or by third parties, or if there are any other reasons outside of TRUE GLASSY LTD's sphere of influence that affect the executability of the Application.

You are required to inspect the Application immediately after installing it and notify TRUE GLASSY LTD about issues discovered without delay by e-mail provided in Product Claims. The defect report will be taken into consideration and further investigated if it has been mailed within a period of three hundred sixty (360) days after discovery.

If we confirm that the Application is defective, TRUE GLASSY LTD reserves a choice to remedy the situation either by means of solving the defect or substitute delivery.

In the event of any failure of the Application to conform to any applicable warranty, you may notify the App-Store-Operator, and your Application purchase price will be refunded to you. To the maximum extent permitted by applicable law, the App-Store-Operator will have no other warranty obligation whatsoever with respect to the App, and any other losses, claims, damages, liabilities, expenses and costs attributable to any negligence to adhere to any warranty.

TERMINATION

The license is valid until terminated by TRUE GLASSY LTD or by you. Your rights under this license will terminate automatically and without notice from TRUE GLASSY LTD if you fail to adhere to any term(s) of this license. Upon license termination, you shall stop all use of the Application, and destroy all copies, full or partial, of the Application.

 

The Application may contain testimonials by users of our products and/or services. These testimonials reflect the real-life experiences and opinions of such users. However, the experiences are personal to those particular users, and may not necessarily be representative of all users of our products and/or services. We do not claim, and you should not assume, that all users will have the same experiences. YOUR INDIVIDUAL RESULTS MAY VARY.

The testimonials on the Application are submitted in various forms such as text, audio, and/or video, and are reviewed by us before being posted. They appear on the Application verbatim as given by the users, except for the correction of grammar or typing errors. Some testimonials may have been shortened for the sake of brevity where the full testimonial contained extraneous information not relevant to the general public.

The views and opinions contained in the testimonials belong solely to the individual user and do not reflect our views and opinions. We are not affiliated with users who provide testimonials, and users are not paid or otherwise compensated for their testimonials.

The testimonials on the Application are not intended, nor should they be construed, as claims that our products and/or services can be used to diagnose, treat, mitigate, cure, prevent, or otherwise be used for any disease or medical condition. No testimonials have been clinically proven or evaluated.

MISCELLANEOUS

If any of the terms of this agreement should be or become invalid, the validity of the remaining provisions shall not be affected. Invalid terms will be replaced by valid ones formulated in a way that will achieve the primary purpose.

Collateral agreements, changes, and amendments are only valid if laid down in writing. The preceding clause can only be waived in writing.

This license agreement is governed by the laws of Latvia, excluding its conflicts of law rules.
